Welcome to Anthrobotics! 1. These Terms and Conditions (hereon referred to as "Terms") govern your use of our website (Anthrobotics.ca), services, products, and networks, and provide information about the Anthrobotics website, services, products, and networks, outlined below. When you create an Anthrobotics account or use our website, services, products, or networks ("solutions"), you agree to these terms. 2. Accepting the Terms 2.1 In order to use the website, services, products, and networks, you must first agree to the Terms. You may not use our website, services, products, or networks, if you do not accept the Terms. 2.2 You can accept the Terms by simply using the website, or by accepting the Terms during account creation, where account creation is required to use our services, products, and networks. You understand and agree that Anthrobotics will treat your use of the website, our services, products, or networks as acceptance of the Terms from that point onwards. 2.3 You may not use the website, our services, products, or networks and may not accept the Terms if (a) you are not of legal age to form a binding contract with Anthrobotics, or (b) you are a person who is either barred or otherwise legally prohibited from receiving or using the website, services, products, or networks under the laws of the country in which you are a resident or from which you access or use the website, services, products, or networks. 3. Who can use Anthrobotics 3.1 In order to use our website, services, products, or networks, you must meet the following conditions: 3.1.1 You must be at least 13 years old. 3.1.2 We must not have previously disabled your account for violation of the law or any of our policies. 3.1.3 You must not be a citizen or resident of (a) Ukraine or (b) Israel, as the aforesaid parties are involved in an ongoing armed conflict on the territory of the aforesaid countries. 3.1.4 You must not be a member of a government or military organization of (a) Ukraine or (b) Israel, taking part in hostilities or armed conflict on the territory of the aforesaid country. 3.1.5 You must not be a convicted sex offender. 3.1.6 You must not be currently employed by a private or publicly traded company or entity, involved in hostilities or an ongoing armed conflict. 4. Prohibited Conduct 4.1 You will not use our website, services, products, or networks to do any of the following: 4.1.1 Obtain or attempt to obtain unathorized access to the website, servers, systems, networks, products, or data. 4.1.2 Make available any content that is harmful to children, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, degenerate, or hateful. 4.1.3 Violate any applicable laws or regulations. 4.1.4 Impersonate any person or entity, or forge or manipulate headers or identifiers to disguise the origin of any content or data transmitted through our website, services, products, or networks. 4.1.5 Make available any content that you do not have the right to make available or that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any person or entity. 4.1.6 Post content containing advertisements or other commercial solicitations. 4.1.7 Make available or distribute viruses or any other computer code, files, programs, or content designed to interrupt, destroy, or limit the functionality of our website, services, products, or networks. 4.1.8 Interfere with or disrupt our website, servers, data, systems, services, products, or networks. 5. COMSEC and Cryptographic Material 5.1 Anthrobotics services, products, and networks may contain cryptographic devices and material that may or may not be accessible to the end user. By accepting the Terms, you also accept the following terms and conditions of the Anthrobotics COMSEC and Cryptographic Regulations (hereon referred to as "ACCR"): 5.1.1 You shall not attempt to access, order, view, transfer, load, issue, fill, destroy, tamper with, or otherwise manipulate cryptographic key material (hereon referred to as "keymat") unless you are a custodial staff member on an Anthrobotics COMSEC account. 5.1.2 You shall not attempt to access, order, view, transfer, load, issue, fill, destroy, tamper with, or otherwise manipulate cryptographic devices, keymat management software, or encrypted computer networks unless you are a custodial staff member on an Anthrobotics COMSEC account. 5.1.3 You shall not impersonate any custodial staff. 5.1.4 You shall not attempt to apply for an Anthrobotics COMSEC account if you are an entity, member, or employee of an entity, government, or military organization of (a) Ukraine or (b) Israel. 5.1.5 You acknowledge that noncompliance with the ACCR will result in an immediate suspension of account access privileges, services, product functionality, and network access. An investigation into any instance of noncompliance will be launched, and any findings of intentional, deliberate, or planned violations of the ACCR shall result in criminal prosecution to the fullest extent under Canadian law. 6. Termination 6.1 On becoming aware of any potential violation of the Terms, Anthrobotics reserves the right (but shall have no obligation) to decide whether the potential violation may result in the violating party being subject to either temporary or permanent disciplinary action, including, but not limited to, suspension or termination of account, deactivation of software, removal of network access privileges, deactivation or "bricking" of products, and criminal prosecution. These actions may be taken by Anthrobotics at any time, without prior notice, and at its sole discretion. Parties found to be in violation of the Terms will be notified after disciplinary action has been taken. 6.2 If the violation has been deemed to be undeserving of a permanent disciplinary action, the violating party will be warned against further violations of the Terms, and directed to read the section of the Terms that the party violated. The violating party will be required to complete a test covering the Terms in full, and upon completion with a passing grade, they will have the temporary disciplinary measures lifted. 6.3 If the violation has been deemed to be deserving of a permanent disciplinary action, the disciplinary action will remain in place. The violating party will be informed of the exact nature of the violation and will be prohibited from using any Anthrobotics service, products, or networks indefinitely. If the violation of the Terms is egregious enough to be considered a criminal offense under Canadian law, the violating party shall be prosecuted under Canadian law. 7. Governing Law and Venue 7.1 If you have an issue or dispute, you agree to raise it and resolve it with us informally. You agree to contact us with feedback and concerns by emailing support@anthrobotics.ca. 7.2 Any claims arising out of or relating to the Terms will be governed by Canadian law. All disputes related to the Terms will be brought solely in the Court of King's Bench of Alberta located in Edmonton or the Alberta Court of Justice located in Edmonton, and you consent to personal jurisdiction in these courts. 8. Limits on Liability and Warranty 8.1 Anthrobotics strives to provide the best solutions we can and to specify clear guidelines for everyone who uses them. Our solutions, however, are provided "as is", and we make no guarantees that they will always be safe, secure, or error-free, or that they will function without disruptions, delays, or imperfections. To the extent permitted by law, we also DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Anthrobotics does not control or direct what people, entities, and others do or say, and we are not responsible for their actions or conduct (whether online or offline), any content they share (including offensive, inappropriate, obscene, unlawful, degenerate, and other objectionable content), or the intentional misuse of services, products, or networks (for purposes including, but not limited to, criminal activity, terrorism, corporate espionage, corporate warfare, spying, and illegal export of technology). 8.2 Anthrobotics cannot predict when issues might arise with our solutions. Accordingly, our liability shall be limited to the fullest extent permitted by applicable law, and under no circumstances will we be liable to you for any loss of life, disability, injury to persons or material, injury to national interest, lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to the Terms or Anthrobotics solutions, even if we have been advised of the possibility of such damages. Our aggregate liability arising out of or relating to the Terms or Anthrobotics solutions will not exceed the greater of $100 or the amount you have paid us in the past twelve months. 9. Intellectual Property 9.1 Anthrobotics retains all copyright and trademark rights over all branding, logos, domain names, products, services, networks, and other notable brand features, including "The Friendly Future of Robotics", "The Anthro", "Anthronet", "AnthroCrypt", "AnthroDrive", "AnthroMind", and "Project '87", developed by and owned by Anthrobotics. The aforesaid are protected by copyright, trademarks, and other laws of both Canada and foreign countries. Nothing in the Terms gives you a right to use the Anthrobotics name or any of the Anthrobotics trademarks, logos, domain names, and other distinctive brand features. All rights, titles, and interests in and to the website, services, products, and networks (excluding user-generated and user-uploaded content) are and will remain the exclusive property of Anthrobotics and its licensors. Any feedback, comments, reviews, or suggestions you may provide regarding Anthrobotics or the services, products, or networks is entirely voluntary and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you. 10. Third-Party Content, Advertisements, and Promotions 10.1 Our website may contain links to our content hosted on third-party websites. We are not responsible for any third-party websites, their products, services, or the content hosted on them. Your use of third-party websites is at your own risk, and you should make any investigation you feel necessary before proceeding with any interaction or transaction in connection with third-party websites. 10.2 Our website does not contain third-party advertising or sponsored content of any kind. 11.
